Terms and conditions
1. Introduction & Acceptance
By commissioning artwork or related services from the Artist (hereafter referred to as 'the Artist'), you (hereafter referred to as 'the Client') agree to the following Terms and Conditions. These terms are legally binding and apply to all commissions unless otherwise agreed in writing.
2. Scope of Work
The Artist agrees to provide traditional artwork services as commissioned by the Client. The Client must provide adequate references for any characters, designs, or poses requested. Failure to provide sufficient references may result in additional fees. The Artist reserves the right to refuse commissions that include, but are not limited to: offensive content, explicit NSFW material, or material the Artist is uncomfortable producing.
3. Payment Terms
a) All payments are to be made in USD via PayPal (Invoice method only).
b) Commissions under $100 must be paid in full up front. For commissions over $100, a deposit of 25% must be paid before work on their commission will begin
c) Payment must be made within 48 hours of invoice issuance, unless otherwise agreed. d) Failure to pay may result in cancellation of the commission and blacklisting.
4. Refunds & Cancellations
a) A full refund (100%) is available only if the Artist has not yet started the sketch. b) Once a sketch is started,no refunds will be issued.
c) If the Artist cancels the project, a full refund will be provided.
d) Chargebacks are strictly prohibited. Any unauthorized chargebacks will result in permanent blacklisting.
5. Copyright & Usage Rights
a ) The Artist retains full copyright and moral rights to the artwork created.
b ) The Client may use the artwork for personal, non-commercial purposes only.
c ) The Client may not use the artwork for blockchain-related technologies, including NFTs or AI dataset training.
d ) The Client must provide proper credit to the Artist whenever the artwork is displayed publicly.
6. Restrictions
The Client is not permitted to:
- Claim the artwork as their own.
- Remove watermarks or signatures.
- Redistribute, resell, or modify the artwork without permission.
- Use the artwork in any offensive, defamatory, or unlawful manner.
7. Revisions & Feedback
a) The Client is entitled to two major revisions during the sketching stage.
b) After the sketch stage, only minor adjustments are permitted without extra cost.
c) Additional revisions beyond the agreed scope will incur extra fees.
d) The Artist is not responsible for dissatisfaction if the Client fails to provide timely feedback.
8. Delivery & Final Product
a) The final product will be delivered via post, unless otherwise agreed.
b) The Artist may showcase the commissioned artwork in their portfolio or social media unless a Non-Disclosure Agreement (NDA) is purchased.
9. Confidentiality / NDA
If the Client requests a private commission, an additional NDA fee (minimum 5% of total commission cost) may apply. The Artist will then refrain from sharing WIPs or final works publicly.
10. Liability Disclaimer
The Artist is not liable for any damages, losses, or claims arising from the Client's use of the commissioned artwork. The artwork is provided 'as is' without warranties of any kind.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Artist’s country of residence. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located therein.
